AtHomeNet charged with Violation of the Computer Fraud and Abuse Act, Copyright Act, et al
AtHomeNet, Inc. (www.AtHomeNet.com), homeowners association Web Site provider, along with its owners, are currently in Colorado Federal District Court charged with violation of the Computer Fraud and Abuse Act, violation of the Copyright Act, Fraud, Aiding and Abetting Fraud, and other allegations as filed by AssociationVoice in its Federal Complaint. The claims made by AssociationVoice arise following its discovery that AtHomeNet’s owners Susan Sanders and Jeff Sanders, along with other AtHomeNet employees, created a fictitious homeowners association and then used that fictitious homeowners association to fraudulently subscribe to AssociationVoice’s services and obtain access to secured administration areas reserved for legitimate clients.
To date, AtHomeNet has admitted creating and funding the scheme described above involving the fictitious homeowners association. AssociationVoice has also obtained evidence that AtHomeNet used its improper access for development purposes. As such, AssociationVoice has asked the Federal Court to grant a Preliminary Injunction ordering AtHomeNet to cease and desist from improperly accessing AssociationVoice's Web site; to stop marketing any software features that AtHomeNet developed through the use of its improper scheme; and to require AtHomeNet to pay damages.
AssociationVoice’s investigation, now being conducted primarily through its litigation attorneys, is ongoing. A trial date has yet to be finalized.
